Parties to This Proceeding and Applications for Rehearing

Information on being a party to this proceeding and applying for a rehearing.

I. Mid-Atlantic Area National Corridor (Docket No. 2007-OE-01)

The May 7 notice provided instructions on how to provide comments and how to become a party to the proceeding in this docket. Consistent with those instructions, DOE is granting party status in this docket to all persons who either:

  1. filed comments marked "Attn: Docket 2007-OE-01" electronically at http://nietc.anl.gov on or before July 6, 2007;

  2. mailed written comments marked "Attn: Docket No. 2007-OE-01" to the Office of Electricity Delivery and Energy Reliability, OE-20, U.S. Department of Energy, 1000 Independence Avenue SW, Washington, DC 20585, that were received on or before July 6, 2007; or

  3. hand-delivered written comments marked "Attn: Docket No. 2007-OE-01" at one of the public meetings. Only those persons who are parties to the proceeding in Docket No. 2007-OE-01 and who are aggrieved by the order in that docket may apply for rehearing pursuant to FPA section 313.

II. Southwest Area National Corridor (Docket No. 2007-OE-02)

The Department grants party status in Docket No. 2007-OE-02 to all persons who either:

  1. filed comments marked "Attn: Docket 2007-OE-02" electronically at http://nietc.anl.gov on or before July 6, 2007;

  2. mailed written comments marked "Attn: Docket No. 2007-OE-02" to the Office of Electricity Delivery and Energy Reliability, OE-20, U.S. Department of Energy, 1000 Independence Avenue SW, Washington, DC 20585, that were received on or before July 6, 2007; or

  3. 3) hand-delivered written comments marked "Attn: Docket No. 2007-OE-02" at one of the public meetings. Only those persons who are parties to the proceeding in Docket No. 2007-OE-02 and who are aggrieved by the order in that docket may apply for rehearing pursuant to FPA section 313.

III. Application for Rehearing

Any application for rehearing must be either:

  1. mailed or hand-delivered to the Office of Electricity Delivery and Energy Reliability, OE-20, U.S. Department of Energy, 1000 Independence Avenue SW, Washington, DC 20585; or

  2. faxed to 202-586-8008.

Applications for rehearing of the order in Docket No. 2007-OE-01 must be marked "Attn: Docket No. 2007-OE-01." Applications for rehearing of the order in Docket No. 2007-OE-02 must be marked "Attn: Docket No. 2007-OE-02." Applications for rehearing must be received by 5:00 p.m., Eastern time, November 5, 2007. The Department will not accept responses to requests for rehearing. Note: Delivery of U.S. Postal Service mail to DOE continues to be delayed by several weeks due to security screening; therefore, applicants who choose to mail their rehearing applications are encouraged to use express mail.

Although the Orders indicate that applications for rehearing may be faxed to the Department at 202-586-8008 prior to 5:00 pm EST on Monday, November 5, please be advised that there is a limited capacity to receive incoming faxes. Accordingly, the Department strongly recommends that applicants use express mail service for the delivery of your rehearing request. However, if you do use fax, in order to comply with the "received by 5:00 pm EST" deadline, we encourage you to send your fax early in the day on Monday, November 5, or, better still, prior to that date. We emphasize that a rehearing request received by the Department after 5:00 pm EST on November 5, whether by fax to 202-586-8008 or otherwise, will not be considered as timely filed.

Parties requesting rehearing under FPA section 313 are not required to serve the rehearing request on the parties to Docket Nos. 2007-OE-01 and 2007-OE-02. All rehearing requests will be posted at this site.

STATEMENT FROM JULIE RUGGIERO, U.S. DEPARTMENT OF ENERGY SPOKESPERSON:

"In October, DOE designated two National Interest Electric Transmission Corridors in the Northeast and Southwest United States - two of the Nation's most populous regions with growing electricity congestion problems. The Department based its designations on sound data and analysis showing that there is persistent electricity transmission congestion within the corridors.

"These designations followed two months of public review and comment in which time over 2,000 comments were received and evaluated in addition to over 60 hours of public meetings held across the country.

"Last month, various parties requested that the Department review these designations. In order to give these requests full consideration, DOE will take additional time to thoroughly evaluate the basis of their requests.

"Ensuring adequate infrastructure to supply affordable, reliable, and secure electricity to Americans is a national priority and through these designations, the Department is focusing attention on the need for action to keep pace with America's growing energy appetite."
